ROBERT DABNEY, et al., Plaintiff(s), ) ) ) ) ) ) ) ) ) ) UNITED STATES DISTRICT COURT NORTHERN DISTRICT OF CALIFORNIA No. C09-4116 BZ ORDER DENYING PLAINTIFFS' MOTION FOR LEAVE TO FILE THIRD AMENDED COMPLAINT motion is DENIED because they have not made the necessary showing under FRCP 16(b)(4) that there is "good cause" to modify the pretrial scheduling order and permit such an amendment. Plaintiffs have not offered any reasonable explanation as to why they waited until the eve of trial to seek leave.
