This matter having come before the Court on the parties' Notice of Settlement and Request for Conditional Dismissal with Prejudice, it is hereby ORDERED, ADJUDGED, and DECREED That this action is and all claims asserted therein are dismissed with prejudice. In the event that the settlement is not reached, any party may move to reopen the case and the trial will be rescheduled, provided that such motion is within ninety (90) days of this Order. All scheduled dates, including the January 8, 2010 Case Management Conference, are vacated.
