Plaintiff intends to file a Motion for Preliminary Approval of Class Action 6 Settlement; 7 2. The parties agree that the notice period of filing a motion 35 days before a hearing 8 date, set forth in Local Rule 7-2, is not necessary as no opposition will be filed; 9 3. Plaintiff has consulted with Judge Illston’s clerk and has determined that the next 10 available date on Judge Illston’s calendar is November 16, 2011, at 2 p.m. 11 THEREFORE, the parties stipulate and hereby request the Court order that: 12 1. Plaintiff is not required to give a 35-day notice of her impending Motion for 13 Preliminary Approval; 14 2. Plaintiff’s Motion for Preliminary Approval of Class Action Settlement will be 15 heard on November 16, 2011, at 2 p.m.; 16 3.
