C09-04798 TEH ORDER DISMISSING CASE IN THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF CALIFORNIA United States District Court 11 For the Northern District of California 12 13 14 15 16 This matter came before the Court on December 14, 2009, on the motion for 17 preliminary injunction of Plaintiff Osvaldina Lima ("Plaintiff"), and the motion to dismiss of 18 Defendant Wachovia Mortgage FSB. The Court, ruling from the bench, DENIED the motion 19 for preliminary injunction and GRANTED the motion to dismiss without prejudice. Plaintiff 20 was given leave to file an amended complaint within 45 days. 21 Plaintiff has not filed an amended complaint with the 45-day period allowed by the 22 Court. Therefore, with good cause appearing, this matter is DISMISSED WITH 23 PREJUDICE. The Clerk shall close the file. 24 25 IT IS SO ORDERED. 26 27 Dated: 2/03/10 28 THELTON E.
