Once these access issues have been resolved and the investigation report has been finalized which the environmental consultants estimate will take approximately 30 to 60 days, the parties will need an additional estimated 30 to 60 days to assess the results, and an additional estimated 30 to 60 days to conduct settlement talks, Plaintiffs Richard G. ADR Program: The Court previously referred this matter to private mediation. The Parties subsequently agreed upon mediator Timothy Gallagher. 16 17 The Parties have conducted formal in-person mediations on two occasions and have held 18 multiple telephonic settlement communications directly between Parties and with the mediator. 19 These communications have proven to be positive and have resulted in the Parties agreeing to 20 conduct additional investigatory work to better estimate future remediation costs which can then be 21 allocated between the Parties. Pretrial Motions: 26 27 28 -1FOURTH AMENDED CASE MANAGEMENT ORDER 1 All pretrial motions shall be filed in accordance with Civil Local Rule 7. A motion may be 2 noticed pursuant to Civil Local Rule 7-2 without calling the Court. Civil law and motion is heard on 3 Thursday mornings at 10:00 a.m. 4 D. Discovery: 5 6 The parties shall abide by Magistrate Judge James’ Standing Order Regarding Discovery and 7 Dispute Procedures. 8 E. Disclosure of Expert Witnesses: 9 1. REED SMITH LLP A limited liability partnership formed in the State of Delaware 10 Any party wishing to present expert witness testimony with respect to a claim 11 or defense shall serve on all other parties the name, address, qualifications, resume, and a written 12 report which complies with Federal Rule of Civil Procedure 26(a)(2)(B) by March 4, 2014. 13 2. This disclosure must be made with respect to a person who is either: (a) 14 specifically retained or specially employed to provide expert testimony pursuant to Federal Rule of 15 Evidence 702; or (b) a regular employee or agent or treating physician who may be called to provide 16 expert opinion testimony. 17 3. 18 A party or counsel has a continuing duty to supplement the disclosure of 19 expert witnesses when required under Federal Rule of Civil Procedure 26(e)(1). 20 F. Rebuttal Expert Witnesses: 21 22 If the testimony of an expert is intended solely to contradict or rebut opinion testimony on the 23 same subject matter identified by another party, the party proffering a rebuttal expert shall disclosure 24 the information required under Federal Rule of Civil Procedure 26(a)(2)(B) by March 24, 2014. 25 G. Limitation on Testimony by Expert Witnesses: 26 27 1. Unless the parties enter into a written stipulation otherwise, upon timely 28 objection, an expert witness shall be precluded from testifying about any actions or opinions not -2– FOURTH AMENDED CASE MANAGEMENT ORDER 1 disclosed prior to the expert’s deposition. This is to ensure that all factual material upon which 2 expert opinion may be based is disclosed, and all tests and reports are completed, prior to the expert 3 deposition. 4 2. Unless application is made prior to the close of expert discovery, each party is 5 limited to calling only one expert witness in each discipline involved in the case. 6 3. 7 Any party objecting to the admissibility of the testimony of a person disclosed 8 as an expert witness must file a written motion in limine to exclude the testimony by the deadline set 9 forth below. Close of Discovery: 11 1. 12 All discovery, including depositions of expert witnesses, must be completed 13 by May 1, 2014. 14 2. Pursuant to Federal Rule of Civil Procedure 16(b) and Civil Local Rule 26-2, 15 a discovery request or stipulation that calls for responses or depositions after the discovery cutoff 16 date is not enforceable except by order of the Court and upon a showing of good cause. 17 3. 18 Pursuant to Civil Local Rule 26-2, no motions to compel discovery (including 19 joint letters and requests for telephonic conferences under Magistrate Judge James' discovery 20 standing order) may be filed later than 10 days after the discovery cutoff date. 21 I. Dispositive Motions: 22 23 1. Pursuant to Civil Local Rule 7-2, all dispositive motions shall be filed, served, 24 and noticed by May 19, 2014. The parties shall file a joint statement of undisputed facts pursuant to 25 Civil Local Rule 56-2(b) when filing a motion for summary judgment. 26 27 28 -3– FOURTH AMENDED CASE MANAGEMENT ORDER 2. 1 The Court shall hear dispositive motions on or before July 10, 2014 at 10:00 2 a.m. in Courtroom B, 15th Floor of the Federal Building, located at 450 Golden Gate Avenue, San 3 Francisco, California. 4 J. Exchange and filing of Trial Papers: 5 6 1. By August 4, 2014 lead counsel who will try the case shall meet and confer 7 with respect to the preparation and content of the joint pretrial conference statement and shall 8 exchange (but not file or lodge) the papers described in paragraph 2 below. 9 2. By August 18, 2014 counsel shall file the papers described in Federal Rule of REED SMITH LLP A limited liability partnership formed in the State of Delaware 10 Civil Procedure 26(a)(3) and a joint pretrial conference statement including the following: 11 12 (A) Substance of the Action: A brief description of the substance of claims 13 and defenses which remain to be decided. 14 (B) Relief Prayed: A detailed statement of all the relief claimed, 15 particularly itemizing all elements of damages claimed as well as witnesses, documents or other 16 evidentiary material to be presented concerning the amount of damages. 17 18 (C) Undisputed Facts: A plain and concise statement of all relevant facts 19 not reasonably disputable, as well as which facts parties will stipulate for incorporation into the trial 20 record without the necessity of supporting testimony or exhibits. 21 (D) Disputed Factual Issues: A plain and concise statement of all disputed 22 factual issues which remain to be decided. 23 24 (E) Agreed Statement: A statement assessing whether all or part of the 25 action may be presented upon an agreed statement of facts. 26 (F) Stipulations: A statement of stipulations requested or proposed for 27 pretrial or trial purposes. 28 -4– FOURTH AMENDED CASE MANAGEMENT ORDER (G) 1 Witness list: A list of all witnesses to be called for trial. The parties 2 shall submit a page length detailed summary of the substance of the proposed testimony of each 3 witness, which shall also specify to which disputed fact the testimony relates, and an estimate of the 4 time required for direct and cross examination of each witness. 5 (H) Exhibit list: A list of all exhibits to be offered at trial. The list shall 6 state each proposed exhibit by its number or alphabetical letter, description and sponsoring witness. 7 All documents shall be authenticated prior to trial. 8 (I) 9 No party shall be permitted to offer any witness or exhibit that is not REED SMITH LLP A limited liability partnership formed in the State of Delaware 10 disclosed in its witness or exhibit list, except with leave of the Court for good cause shown. 11 (J) Estimated Time of Trial: An estimate of the number of hours needed 12 for the presentation of each party’s case. 13 (K) 14 Settlement: A statement summarizing the status of the parties’ 15 settlement negotiations. 16 3. Motions in limine: Counsel are directed to meet and confer to resolve any 17 evidentiary disputes prior to filing motions in limine. 18 (A) Any motions in limine shall be filed by August 18, 2014. (B) Any Opposition to motions in limine shall be filed by August 25, 2014. (C) 19 These matters will be deemed submitted on the papers without oral 20 21 22 23 argument, unless the Court orders otherwise. 24 4. Trial Briefs: Counsel shall file trial briefs setting forth the applicable legal standard, 25 pursuant to Ninth Circuit authority, for all significant disputed issues of law, including foreseeable 26 procedural and evidentiary issues, by September 8, 2014. 27 28 -5– FOURTH AMENDED CASE MANAGEMENT ORDER 1 5. Joint Proposed Voir Dire: Counsel shall file a joint set of requested voir dire to be 2 posed by the Court by September 1, 2014. Any voir dire questions on which counsel cannot agree 3 shall also be filed separately by September 1, 2014. Counsel will be allowed brief follow up voir dire 4 after the Court’s questioning. 5 6. Joint Proposed Jury Instructions: 6 (A) 7 Counsel shall file a joint set of additional proposed jury instructions by 8 September 1, 2014. Jury instructions from the Manual of Model Civil Jury Instructions for the Ninth 9 Circuit should be used whenever possible. The instructions shall be ordered in a logical sequence, REED SMITH LLP A limited liability partnership formed in the State of Delaware 10 together with a table of contents. 11 (B) Any instruction on which counsel cannot agree shall be marked as 12 “disputed” and included within the jointly submitted instructions and accompanying table of 13 contents, in the place where the party proposing the instruction believes it should be given. 14 Argument and authority for and against each disputed instruction shall be included as part of the 15 joint submission, on a separate page directly following the disputed instruction. 16 (C) 17 The Court prefers that all jury instructions conform to the Manual of 18 Model Civil Jury Instructions for the Ninth Circuit. 19 (D) Counsel shall deliver to the Courtroom Deputy a copy of their joint 20 proposed jury instructions on a portable storage medium (such as a USB thumb drive) in 21 WordPerfect format. The label shall include the name of the parties, the case number and be entitled 22 “Proposed Jury Instructions.” 23 (E) 24 At the close of Defendant’s case in chief, the Court shall hear oral 25 argument on the disputed jury instructions and will then render its rulings. 26 7. Proposed Verdict Forms, Joint or Separate: Counsel shall file any joint 27 proposed verdict forms, as well as any separate verdict forms, by September 1, 2014. Counsel shall 28 -6– FOURTH AMENDED CASE MANAGEMENT ORDER 1 deliver to the Courtroom Deputy a copy of their joint proposed verdict forms on a portable storage 2 medium in WordPerfect. The label shall include the name of the parties, the case number, and be 3 entitled “Proposed Verdict Forms.” 4 K. Pretrial Conference: 5 6 On September 4, 2014 at 10:00 a.m., the Court shall hold a pretrial conference in Courtroom 7 B, 15th Floor, 450 Golden Gate Avenue, San Francisco, California. Lead counsel who will try the 8 case must attend the pretrial conference. The purpose of the pretrial conference is for the Court to 9 rule on any issues raised in the pretrial conference statement, motions in limine, and to discuss the REED SMITH LLP A limited liability partnership formed in the State of Delaware 10 trial of the case. 11 L. Final Pretrial Conference: 12 13 September 18, 2014 at 10:00 a.m. in Courtroom B, the Court shall hold a final pretrial 14 conference to address any outstanding trial issues. 15 M. Trial Date: 16 The trial (including jury selection) shall commence on September 22, 2014 9:30 a.m. - 3:30 p.m. Friday 18 (Trial schedule: Monday through Thursday, at 1:30 p.m. to 5:00 p.m.). The trial shall last an 5 19 estimated eight days. 17 1. 20 2. For any documents, including the deposition of a witness testifying at trial, 21 which will be shown to a witness but not admitted into evidence, counsel shall bring the original plus 22 three copies of the documents. The original document will be handed to the Court during testimony 23 and the copies will be given to the witness during the examination and to opposing counsel. 24 25 3. (A) Counsel shall maintain their own exhibits during trial. Exhibits are to 26 be pre-marked with exhibit tags attached to the upper left-hand corner. If a photo or chart is being 27 used as an exhibit, the exhibit tag should be placed on the back side of the exhibit. The Court will 28 only admit pre-marked exhibits which were listed on the earlier filed exhibit list. -7– FOURTH AMENDED CASE MANAGEMENT ORDER (B) 1 Plaintiff shall mark the exhibits numerically; Defendant shall mark the 2 exhibits alphabetically. The exhibit markers shall each contain the name and number of the case, the 3 number or alphabetical letter of the exhibit, and blank spaces to accommodate the date admitted and 4 the Deputy Clerk’s initials. 5 4. On the day of trial, counsel shall bring the original pre-marked exhibits, a 6 copy of the pre-marked exhibits for opposing counsel, and two binders which contain a copy of each 7 side’s pre-marked exhibits for the Court. The pre-marked exhibit binders are to be designated with 8 label dividers and given to the Courtroom Deputy on the morning of the trial. 9 REED SMITH LLP A limited liability partnership formed in the State of Delaware 10 N. Jury Selection: 11 1. The Jury Commissioner will summon 20 to 25 prospective jurors. The 12 Courtroom Deputy will select their names at random and seat them in the courtroom in the order in 13 which their names are called. 14 2. 15 Voir dire will be asked of sufficient venire persons that eight (or more for a 16 lengthy trial) will remain after all peremptory challenges and an anticipated number of hardship 17 dismissals and cause challenges have been made. 18 3. The Court will then take cause challenges and discuss hardship claims from 19 the individual jurors at side bar. The Court will inform the attorneys which hardship claims and 20 cause challenges will be granted, but will not announce those dismissals until the process is 21 completed. Each attorney may then list in writing up to three peremptory challenges. The attorneys 22 will review each other’s lists and then submit them to the clerk. 23 24 4. From the list of jurors in numerical order, the Court will strike the persons 25 with meritorious hardships, those excused for cause, and those challenged peremptorily. The Court 26 will then call the first eight people in numerical sequence remaining. These people will be the jury. 27 All jurors remaining at the close of the case will deliberate. There are no alternates (unless there is a 28 lengthy trial). -8– FOURTH AMENDED CASE MANAGEMENT ORDER 1 O. Sanctions: 2 Failure to comply with this Order is cause for sanctions under Federal Rule of Civil 3 Procedure 16(f). 4 5 P. Transcripts and Recording Devices: 6 1. Counsel requesting a daily transcript shall contact Debra Campbell, 7 Supervisor Court Reporting Services, at (415) 522-2079, at least ten days in advance of the trial date. 8 2. 9 If any video or tape recording equipment or demonstrative devices will be REED SMITH LLP A limited liability partnership formed in the State of Delaware 10 used, a signed order will need to be obtained at least ten days in advance of the trial date for the 11 items to clear security. 12 Q.
