On July 27, 2010, the Court ordered Plaintiff James W. James to show cause why this case should not be dismissed for failure to prosecute and comply with court deadlines. Although Plaintiff has not responded directly to the osc, he has now filed an opposition to Defendant's pending motion to dismiss. Accordingly, the Court hereby DISCHARGES the order to show cause. Defendant shall file any reply to Plaintiff's opposition by August 12, 2010, and the Court shall conduct a hearing on Defendant's motion to dismiss on September 2, 2010 at 10:00 a.m. in Courtroom B, 15th Floor, 450 Golden Gate Avenue, San Francisco, California. IT IS SO ORDERED.
