The Summons and 4 5 Complaint were thereafter mailed to Defendant on February 9, 2010 pursuant to the 6 California Rules of Civil Procedure. Defendant's time to file an answer or other responsive pleading was thereafter due on or before March 12, 2010. 7 8 WHREAS this Court issued an order on December 28, 2009 setting the Initial Case Management Conference for April 7, 201 O. 9 10 11 WHEREAS Rosenquest & Associates has only recently been retained by Defendant California Smiles and is currntly involved in a lengthy trial in San Fracisco Superior Court and requires additional time to prepare a response and to prepare for the Case Management Conference and Rule 26 deadlines. WHEREAS all other Defendants in this matter on whom Plaintiff has been able to effectuate service are currently in default, with the exception of Defendant Sandy Hui Xuan Wen, with whom Plaintiff 12 13 14 15 16 17 has reached a settlement.
