In response to the motion to dismiss, Plaintiff has filed both a substantive response to the motion as well as an amended complaint. The filing of an amended complaint moots the pending motion to dismiss. See Fed. R. Civ. P. 15(a)(1)(B). Accordingly, the Court terminates the motion to dismiss filed by the City, vacates the hearing date of April 16, 2010, and accepts the proposed first amended complaint filed March 15, 2010. Defendants must file a responsive pleading, either an answer or a motion to dismiss, by no later than April 16, 2010. IT IS SO ORDERED. Dated: March 18, 2010 JEFFREY S.
