Plaintiff set this matter for a hearing on November 12, 2010 on a motion for leave to amend. However, due to the Court's calendar, that day is not available for hearing the motion. Accordingly, the Court CONTINUES the hearing on the motion for leave to amend to December 17, 2010 at 9:00 a.m. The Court also CONTINUES the further case management conference from November 5, 2010 to December 17, 2010, following the hearing on the motion. The case management statements shall be filed no later than December 10, 2010. The Court HEREBY ORDERS that an opposition to the motion shall be filed by no later than October 20, 2010 and a reply brief shall be filed by no later than October 29, 2010. If the Court determines that the matter is suitable for resolution without oral argument, it will so advise the parties in advance of the hearing date. If the parties wish to modify this schedule, they may submit for the Court's consideration a stipulation and proposed order demonstrating good cause for any modification requested. IT IS SO ORDERED.
