Whereas Defendants Hawk Management L.P, HWC LLC, David S. Callan,

5 and Richard Scott Williams (collectively "Defendants") have filed a Motion to 6 Dismiss Pursuant to Federal Rules of Civil Procedure 12(b)(2) & 12(b)(3), or in the 7 Alternative to Transfer. 8 Whereas Plaintiff Richard Lieberman, as an individual and as Trustee of the 9 Richard Lieberman, M.D. APC Defined Benefit Pension Plan ("Plaintiff") disputes 10 the merits of Defendants' Motion, but does not object to having the underlying 11 dispute heard in Pennsylvania. 12 14 15 THE PARTIES BY AND THROUGH THEIR COUNSEL OF RECORD 1. 2.
