WHEREAS, the Initial Case Management Conference was set for June 29, 2010. WHEREAS, on July 14,2010, the Court sua sponte continued the Initial Case Management Conference to October 2, 1010 at 1:30 pm.; and WHEREAS, lead trial counsel in this action are required to appear at the Initial Case Management Conference, and intend to appear in person. The Parties respectfully request that the Court grant a brief continuance and reschedule the Initial Case Management Conference to Friday, October 8, 2010 at 1:30 p.m. Good cause exists to continue the Initial Case Management Conference because both lead trial counsel for Defendant Diamond Foods, Inc. are out of the area on October 1,2010 on previous commitments. The Parties 7 8 9 10 will not be prejudiced by the short continuance, have met and conferred on the issue, and agree to the brief continuance.
