Plaintiffs Demario D. Driver and Preston D. Marshall ("Plaintiffs") and Defendant Island

5 Procedure 12(b)(6), and Motion to Strike pursuant to Federal Rule of Civil Procedure 12(f) (the 6 "Pending Motions"), are currently set for hearing in this Court on November 2, 2010 at 9:00 a.m.;
