I am an attorney licensed to practice in the State of California and the Northern 10-CV-02213 (DMR) 2 DECLARATION OF DANIEL L. WARSHAW IN SUPPORT OF ADMINISTRATIVE MOTION TO RELATE CASES 1 District of California. I am a partner with the firm of Pearson, Simon, Warshaw & Penny, LLP, 2 one of the law firms representing Plaintiff Jonathan Huber. I am making this declaration in 3 support of Mr. Huber's administrative motion to relate cases. I have personal knowledge of the 4 facts set forth herein and could competently testify to them if called as a witness. 5 2. Attached hereto as Exhibit "A" is a true and correct copy of the Complaint filed in 6 Huber v. Sony Computer Entertainment America, LLC, formerly Sony Computer Entertainment 7 America, Inc. ("Huber"). Huber is currently assigned to the Honorable Donna M. Ryu, Magistrate 8 Judge. The Huber case is a putative nationwide class action brought on behalf of purchasers of 9 PlayStation® 3s ("PS3") with the "Other OS" feature. It arises from Sony Computer 10 Entertainment America, LLC's release of the Firmware Update 3.21, which disabled the "Other 11 OS" feature. It alleges causes of action for breaches of express and implied warranties, 12 conversion, and violations of numerous California and federal consumer protection laws. 13 3. No defendants have yet appeared in Huber or the apparently related cases. Civil 14 Local Rule 3-12 requires parties to "promptly file" any motions to relate cases.
