-1MEKIKI'S NON-OPPOSITION TO FACEBOOK’S MOTION TO STAY

Plaintiffs Mekiki Co., Ltd. and Mekiki Creates Co., Ltd. (collectively, “Mekiki”) hereby
2 submit this statement of non-opposition in response to Facebook, Inc.’s (“Facebook”) Motion to
3 Stay proceedings in this matter (D.I. 66). Mekiki agrees that a stay of the present proceedings is
4 appropriate at least until such time as the U.S. Patent and Trademark Office (“PTO”) issues its
5 decisions on Facebook’s three Petitions for Inter Partes Reexamination of the patents-in-suit, U.S.
6 Patent Nos. 6,879,985, 7,493,342, and 7,496,603.1 If the PTO grants Facebook’s Petitions, and
7 chooses to reexamine the patents-in-suit, Mekiki agrees that a stay of the present proceedings best
8 preserves both the parties’ and the Court’s resources.

Mekiki expects to discuss the impact of the requested stay on the Case Schedule at the
10 upcoming Case Management Conference on March 16, 2011 at 2 P.M.
