WHEREAS, on August 25, 2010, the Court entered an order consolidating five related
2 derivative actions filed on behalf of Akeena Solar, Inc.;
3
WHEREAS, on September 10, 2010, plaintiffs filed a Verified Consolidated Shareholder
4 Derivative Complaint;
5
WHEREAS, on October 7, 2010, the Court entered an order appointing Robbins Umeda
6 LLP and Glancy Binkow & Goldberg LLP as co-lead counsel for plaintiffs;
7
WHEREAS, on December 10, 2010, the Court entered an order dismissing plaintiffs’
8 Section 14(a) claim, and staying the remainder of the action;
9
WHEREAS, on July 15, 2011, defendants filed a Notice of and Motion for Substitution
10 of Counsel;

WHEREAS, on July 28, 2011, the Court entered an order granting defendants’ Motion
12 for Substitution of Counsel;
13
WHEREAS, on August 4, 2011, the Court entered an order continuing the Case
14 Management Conference in this action to September 9, 2011, at 10:30 a.m.;
15
WHEREAS, on September 7, 2011, the Court entered an order continuing the Case
16 Management Conference in this action to October 14, 2011, at 10:30 a.m.;
17
WHEREAS, on October 11, 2011, the Court entered an order continuing the Case
18 Management Conference in this action to December 16, 2011, at 10:30 a.m.; and
19
WHEREAS, the parties believe they would benefit from additional time for the purpose
20 of facilitating a final resolution of this matter and to prepare and complete documentation
21 pursuant thereto.

THEREFORE, IT IS HEREBY STIPULATED AND REQUESTED by the parties, by
23 and through their attorneys of record, that the Case Management Conference presently set for
24 December 16, 2011, at 10:30 a.m. shall be continued to March 16, 2012, at 10:30 a.m., or as
25 soon thereafter as is convenient for the Court.
