See Notice of Removal, ECF No. 1. On June 28, 2010, Defendant Bank of America Corporation ("Defendant") removed this action to federal court on the basis of diversity jurisdiction. Id. Plaintiff's counsel was served with Notice of Removal on the Id. Plaintiff has not filed a motion to remand the same day. case. On July 6, 2010, Defendant filed a motion to dismiss Plaintiff's complaint. ECF No. 7. Plaintiff has yet to file an Opposition or Statement of Non-Opposition.
