On November 3, 2011, Defendants filed a summary-judgment motion. (Docket Nos. 44–

54.) Defendants set the motion to be heard on December 8, 2011. Defendants’ reply regarding

their summary-judgment motion is due on November 28, 2011, based on federal-court holidays.

The parties tenatively agreed to settle the case on November 23, 2011, subject to the

27

approval of Plaintiff Kenneth Gray.
