See Doc #1. At the time he initiated this action, petitioner, a v M MARTELL, Warden, Respondent. / MICHAEL RAY ROGERS, Petitioner, ORDER OF TRANSFER No C-10-3475 VRW (PR) IN THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF CALIFORNIA California prisoner and frequent litigant in federal court, was incarcerated at Mule Creek State Prison in Ione, California (Amador County), which lies within the venue of the Eastern District of California. See 28 USC § 84(b). Venue in a habeas action is proper in either the district of conviction or the district of confinement. Habeas LR 2254-3(a). See 28 USC § 2241(d); For petitions such as the one filed here, Dockets.Justia.com 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 which challenges the loss of time credits ­ ie, the manner in which a sentence is being executed ­ the district of confinement at the time the petition was filed is the preferable forum. See Habeas LR 2254-3(a)(2); Dunne v Henman, 875 F2d 244, 249 (9th Cir 1989) (proper forum to challenge the execution of a sentence is the district where prisoner is confined). Because Amador County lies within the Eastern District of California, pursuant to 28 USC § 1406(a) and Habeas Local Rule 2254-3(b)(2) and in the interest of justice, the court orders this petition TRANSFERRED to the United States District Court for the Eastern District of California. The clerk shall terminate all pending motions as moot, close the file and transfer this matter to the United States District Court for the Eastern District of California. IT IS SO ORDERED.
