F. Dinius (“Dinius”) and Defendant Charles F. Slabaugh (“Slabaugh”) in this action, Dinius by

and through his undersigned counsel of record, respectfully requests that all claims against

Slabaugh in the above captioned action be dismissed with prejudice pursuant to Fed. R. Civ.
