ORDER CONTINUING MOTION HEARING AND SETTING CASE MANAGEMENT CONFERENCE GOOGLE INC., Defendant. / 14 15 Due to a congested law-and-motion calendar and an ongoing patent trial, the motion 16 hearing previously set for October 13 is CONTINUED to a special setting at 9:30 A.M. ON 17 WEDNESDAY, OCTOBER 19, 2011. A case management conference will be held concurrently. 18 Counsel should be prepared to address the following issues: 19 1. How much time the Rule 706 expert will require to 20 complete his work. In particular, a time estimate for completing an 21 independent damages study as opposed to only critiquing the 22 studies provided by the parties’ damages experts. 23 2. The possibility of severing the copyright claim from 24 the patent claims and first conducting a shorter trial on the 25 copyright claim. 26 3. The possibility of general postponement and how 27 best to use any intervening time, for example with respect to 28 motion practice. 1 For the benefit of counsel, please be alerted there is a strong possibility that the final 2 pretrial conference set for October 24 will have to be postponed.
