The Case Management Conference is presently scheduled in this matter to be held on 19 April 21, 2011 at 10:00 a.m. Plaintiff was previously granted leave to file a first amended complaint, 20 and plaintiff did so. Defendants’ Aaron Mosley, Craig Wong, Cory Johnson, Oscar Ortiz and the 21 County of Napa filed a Motion to Dismiss the First Amended Complaint. The court heard oral 22 argument, took the matter under submission and thereafter issued its order granting Defendants’ 23 Motion to Dismiss, with leave to amend as to five of the six causes of action in the first amended 24 complaint (Order filed April 7, 2011 - Document 27.) The court’s order requires plaintiff to amend 25 his first amended complaint within thirty days of the date of the order, if plaintiff intends to proceed. 26 2. Plaintiff intends to file an amended complaint consistent with the court’s order. The 27 public entity defendants expect to file a further motion to dismiss once the amended complaint is 28 filed in light of the court’s order. The parties believe that the Case Management Conference should be continued until 2 such time as the issues regarding the pleadings are resolved to enable the parties to be in a better 3 position to address time frames for discovery and trial.
