STIPULATION

The Court, having read and considered the Joint Stipulation for Entry of Consent Decree that

has been executed on behalf of Plaintiffs Disney Enterprises, Inc. (“Disney”), Warner Bros.

Entertainment Inc. (“Warner Bros.”), DC Comics, Hanna-Barbera Productions, Inc. (“Hanna-

4

Barbera”), and Sanrio, Inc. (“Sanrio”) (collectively “Plaintiffs”), on the one hand, and Defendants

5

Monster Fun Jumps a/k/a Jump City a/k/a Family Fun Jumps a/k/a Mountain House Fun Jumps a/k/a
Dublin Fun Jumps a/k/a Danville Fun Jumps a/k/a Pleasanton Fun Jumps a/k/a San Ramon Fun

Jumps a/k/a Livermore Fun Jumps a/k/a Jumpy House Bouncy House Water Slides Party Rental Co.

and Mark Camarota a/k/a Mark Chance (collectively “Defendants”), on the other hand, and good

ORDERS that this Consent Decree shall be and is hereby entered in the within action as

This Court has jurisdiction over the parties to this action and over the subject matter hereof

pursuant to 17 U.S.C. §§ 101 et seq., 17 U.S.C. § 501, 15 U.S.C. §§ 1051 et seq., 15 U.S.C. § 1121,

28 U.S.C. §§ 1331 and 1338, and 28 U.S.C. § 1367.

registrations listed in Exhibits “A” and “B” attached hereto and incorporated herein by this

reference, and the copyrights and trademarks associated with the same.

Disney Enterprises, Inc. is the owner of all rights in and to the copyright and trademark

Warner Bros. is the owner of all rights in and to the copyright and trademark registrations

listed in Exhibits “C” and “D” attached hereto and incorporated herein by this reference, and the
copyrights and trademarks associated with the same.

DC Comics is the owner of all rights in and to the copyright and trademark registrations

“Plaintiffs’ Properties.”)

of Plaintiffs’ Properties on merchandise, including, but not limited to, moonwalks, banners, and

other accessories, and in the enforcement of their intellectual property rights in Plaintiffs’ Properties.

Plaintiffs have alleged that Defendants, and each of them, have made unauthorized uses of

Plaintiffs’ Properties or substantially similar likenesses or colorable imitations thereof.

Plaintiffs have expended considerable resources in the creation and commercial exploitation

Defendants and their agents, servants, employees and all persons in active concert and

participation with them who receive actual notice of the injunction are hereby restrained and
enjoined from:

a)

directly or contributorily, in any manner, including generally, but not limited to

Infringing Plaintiffs’ copyrights and trademarks in Plaintiffs’ Properties, either

manufacturing, importing, distributing, advertising, selling, offering for sale, or renting any

10

unlicensed product which features any of Plaintiffs’ Properties (“Unauthorized Products”),

11

and, specifically:

i) Importing, manufacturing, distributing, advertising, selling, offering for sale, the

13

Unauthorized Products or any other unauthorized products which picture,

14

reproduce, copy or use the likenesses of or bear a substantial similarity to any of

15

Plaintiffs’ Properties;
ii) Importing, manufacturing, distributing, advertising, selling, offering for sale,

16

renting or offering to rent in connection thereto any unauthorized promotional

17

materials, labels, packaging or containers which picture, reproduce, copy or use
18

the likenesses of or bear a confusing similarity to any of Plaintiffs’ Properties;

19

iii) Engaging in any conduct that tends falsely to represent that, or is likely to

20

confuse, mislead or deceive purchasers, Defendants’ customers and/or members

21

of the public to believe, the actions of the Defendants, the products sold by

22

Defendants, or the Defendants themselves are connected with Plaintiffs, are

23

sponsored, approved or licensed by Plaintiffs, or are affiliated with Plaintiffs; and
iv) Affixing, applying, annexing or using in connection with the importation,

24

manufacture, distribution, advertising, selling, offering for sale, or other use of
25

any goods or services, a false description or representation, including words or

26

other symbols, tending to falsely describe or represent such goods as being those

27

of Plaintiffs.

Each side shall bear its own fees and costs of suit.
