Pursuant to Civil L.R. 16-10(d), the parties to the above-entitled action certify that they

were in email/voicemail communication regarding this matter 10 days prior to the subsequent
3
case management conference scheduled in this case. The parties jointly submit this Supplemental
4
Case Management Statement and Proposed Order and request the Court to adopt it as a
5
Supplemental Case Management Order in this case.

DESCRIPTION OF SUBSEQUENT CASE DEVELOPMENTS
1.
The following progress or changes have occurred since the last case
management statement filed by the parties:
The parties remain optimistic that this case may be resolved for the remaining two
plaintiffs without the need for further judicial intervention.
As noted previously, Mr. Knight has been reinstated into the Navy. Mr. Almy has

submitted all of the paperwork for reaccession requested by the Air Force. A decision on Mr.
13
Almy’s reaccession application is in process. Mr. Loverde must complete the final steps in the
14
reaccession process, which will require him to submit additional paperwork to the Air Force.

After such steps are completed, a decision will be made on Mr. Loverde’s application. The
16
parties remain hopeful that the process as to Plaintiff Almy and Plaintiff Loverde will soon be
17
completed.

The parties jointly request the Court to make the following Supplemental
Case Management Order:

Another Case Management Conference shall be set for May 17, 2012 at 10:00 a.m.

In the interim, the parties shall appear telephonically at the Case Management Conference
22
on March 22, 2012, to answer any further questions the Court may have regarding the status of
23
this case.

In the event the Court feels that a telephonic hearing on March 22, 2012, is not necessary,
25
both parties are amenable to the Court postponing the CMC until May 17, 2012, or such date as is
26
convenient for the Court.
