Pursuant to Federal Rule of Civil Procedure 41(a)(1)(ii), the parties hereby jointly

stipulate to dismissal of this action with prejudice as to Jason Knight (a/k/a Jase Daniels),

Anthony Loverde, and the Navy Defendants (the Department of the Navy and the Secretary of the

5

Navy). Each party will bear its own costs, expenses, and attorneys’ fees as to the now dismissed

6

claims pursued by Messrs. Knight and Loverde.
