On April 29, 2011, the Court ordered Plaintiff to show cause why this case should not be

dismissed for failure to serve the defendant in this matter. However, it now appears that Plaintiff’s
15
proof of service was docketed under a different name. (Dkt. No. 3.) Accordingly, the Court hereby
16
DISCHARGES the April 29, 2001 order to show cause. As Defendant has not appeared in this
17
matter, Plaintiff is directed to file a request for entry of default by the Clerk of Court, pursuant to
18
Federal Rule of Civil Procedure.
