Pursuant to Local Civil Rule 7-3(d), Plaintiff seeks leave to file a supplemental brief

addressing judicial estoppel, and a request for judicial notice attaching the court documents on which

the assertion of judicial estoppel is based. This relief should be granted because the grounds for
4
Plaintiff’s assertion of judicial estoppel did not arise until October 7, 2011 (one week ago), which
5
was too late for Plaintiff to address the issue in his opposition brief, filed August 8, 2011.
