WHEREAS, on February 17, 2012, Defendant Health Robotics, S.R.L. (“Defendant”)

filed its Motion to Dismiss Plaintiffs McKesson Corporation and McKesson Automation, Inc.’s

(“McKesson”) First Amended Complaint Or, in the Alternative, to Stay Pending Arbitration

(“Motion”), and noticed the hearing for March 30, 2012;

WHEREAS, pursuant to Civil Local Rule 7-3, McKesson’s opposition brief is currently
due on March 2, 2012, and Defendant’s reply brief is currently due on March 9, 2012;
WHEREAS, on February 28, 2012, the Court rescheduled the hearing on the Motion to
April 27, 2012;

WHEREAS, in light of the new hearing date and to accommodate the scheduling needs of

McKesson’s counsel, the parties have agreed, subject to the Court’s approval, to a short one-week

11

continuance of the response dates for their respective opposition and reply briefs;

12

NOW, THEREFORE, THE PARTIES HEREBY STIPULATE AND AGREE, through

13

their counsel of record, that McKesson’s opposition brief shall be due on March 9, 2012, and

14

Defendant’s reply brief in support of its Motion shall be due on March 23, 2012.
