SONOMA COUNTY MEN’S ADULT DETENTION FACILITY, 15 Defendants. 16 / 17 Plaintiff, a former county jail inmate proceeding pro se, filed this civil rights action 18 19 under 42 U.S.C. 1983. Defendants have filed a motion for summary judgment, and plaintiff has 20 not filed an opposition. Pursuant to Woods v. Carey, No. 09-15548, slip op. 7871, 7884-85 (9th 21 Cir. July 6, 2012), the following notices and warnings are provided to plaintiff for a second 22 time. 23 Plaintiff must read the following “NOTICE -- WARNING (SUMMARY 24 JUDGMENT),” which is provided to him pursuant to Rand v. Rowland, 154 F.3d 952, 953-954 25 (9th Cir. 1998) (en banc), and Klingele v. Eikenberry, 849 F.2d 409, 411-12 (9th Cir. 1988). If the motion is granted it will end your case. You have the right to present any evidence you may have which tends to show that you 23 did exhaust your administrative remedies. Such evidence may be in the form of declarations 24 (statements signed under penalty of perjury) or authenticated documents, that is, documents 25 accompanied by a declaration showing where they came from and why they are authentic, or 26 other sworn papers, such as answers to interrogatories or depositions. 27 28 If defendants file a motion to dismiss and it is granted, your case will be dismissed and there will be no trial. 2 1 In light of the foregoing notice, plaintiff is granted an extension of time, to and 2 including August 1, 2012, in which to file an opposition to defendants’ motion.
