The initial Case Management Conference in this case was scheduled for July 13, 3 2011. On May 24, 2011, the Court vacated the Case Management Conference and stayed 4 proceedings while the parties pursued mediation. The Court has subsequently four times granted 5 the parties’ request to continue the Case Management Conference to accommodate their post- 6 mediation settlement efforts. The parties are currently scheduled to appear for a Case 7 Management Conference on March 2, 2012 at 9:00 a.m. 8 2. The parties have neared agreement on the material terms of a proposed class action 9 settlement, however, they continue to negotiate in good faith the full details of the settlement. The 10 parties fully expect to be able to either file a Motion for Preliminary Approval (should agreement 11 be reached) or a Case Management Conference Statement (should resolution fail) within two 12 weeks.
