Following the June 1, 2012 preliminary approval hearing and pursuant to the Court’s

direction, the parties hereby file revised versions of the California Notice and National Notice,

3

which incorporate the changes agreed to by the parties. The parties specifically note and bring to

4

the Court’s attention the fact that the revised National Notice does not contain the admonition “IF

5

YOU TAKE NO ACTION, YOU MAY BE SUBJECT TO A RELEASE AND LOSE CLAIMS

6

WITHOUT COMPENSATION,” because National Class Members who do not submit an opt-in

7

and claim form will not in fact be releasing any claims. The California Notice has been revised to

8

include that admonition, per the terms of the parties’ stipulation.
