This is a federal civil rights action. Mail sent by the Court to plaintiff was

19

returned as undeliverable more than 60 days ago. Accordingly, the action is hereby

20

DISMISSED because plaintiff failed to keep the Court apprised of his current address

21

pursuant to Civil Local Rule 3-11(b) and because he failed to prosecute this matter pursuant

22

to Fed. R. Civ. P. 41(b). Defendants’ motion for summary judgment (Docket No. 30) is

23

DENIED without prejudice. The Clerk shall terminate Docket No. 30, enter judgment in

24

favor of defendants, and close the file.
