(“CBK”) and Defendant EQUILON ENTERPRISES LLC, DBA 2 SHELL OIL PRODUCTS US (“Equilon”), having reached a settlement which is reflected in their 3 respective written settlement agreement, and having stipulated by and through their respective 4 counsel of record, and the Court having accepted the stipulation of the parties, 5 IT IS HEREBY ORDERED that pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of 6 Civil Procedure, all claims that CBK has asserted against Equilon in this action are hereby 7 DISMISSED WITH PREJUDICE and that CBK and Equilon are to bear their own costs, expenses 8 and attorney’s fees. 9 IT IS SO ORDERED. 10 11 12 December 11 Dated: _____________________, 2012 _________________________________ HON.
