The Court, having considered this request, is of 5 6 the opinion that their request for dismissal should be GRANTED. IT IS THEREFORE ORDERED that: 7 8 9 1) the above-entitled cause and all claims by MasterObjects against Microsoft made therein are dismissed with prejudice to the re-filing of same; 10 2) the above-entitled cause and all claims and counterclaims by Microsoft against 11 MasterObjects made therein are dismissed without prejudice to the re-filing of 12 same. 13 IT IS FURTHER ORDERED that all attorneys’ fees, costs of court and expenses 14 shall be borne by each party incurring the same. 15 S November 23rd Signed this _____ day of ______________, 2011.
