direct and/or indirect purchaser class actions, In re TFT-LCD (Flat Panel) Antitrust Litig., Case

No. 3:07-MD-1827 SI (“DPP/IPP trial”), now pending in the United States District Court for the

Northern District of California currently scheduled to be held on April 23, 2012, and by

5

“Defendants’ Motion Regarding Trial Structure and For Relief To Avoid Duplicative Recovery.”

Among other things, the parties reflected in the signature block below intend to argue for a

bifurcated trial, consolidation and/or coordination with this action, and issue and claim preclusion

8

based on the trial results to the fullest extent of the applicable law. The existence or scope of any

alleged conspiracies, overcharges, pass-on rates or damages awarded (if any) are among the many
