Plaintiff T-Mobile U.S.A., Inc. (“T-Mobile”) and Defendants Chi Mei Corporation,

Chi Mei Innolux Corporation, Chi Mei Optoelectronics USA, Inc., CMO Japan Co., Ltd.,
25 Nexgen Mediatech, Inc., and Nexgen Mediatech USA, Inc. (collectively “CMI”), by and
26 through undersigned counsel, stipulate and agree that T-Mobile hereby dismisses with
27 prejudice all claims being asserted against CMI in the above-captioned action pursuant to

1 Rule 41(a)(2) of the Federal Rules of Civil Procedure. In support of this stipulation of

1. T-Mobile and CMI seek the dismissal of this action with prejudice.

2. This stipulation does not affect the rights or claims T-Mobile may have against any
5 other defendant or co-conspirator in this litigation.

WHEREFORE, the parties respectfully request that this Court issue the Proposed
7 Order of Dismissal.
