On August 19, 2011, Defendants filed an Answer to the Complaint. [Docket Nos.

On August 24, 2011, the case was referred to Mediation, pursuant to the Court’s

The parties are currently attempting to reach settlement with the goal of resolving

2 this matter without the further intervention of the Court.

Accordingly, the parties herein

3 respectfully request that the Case Management Conference, currently scheduled for September 19,
4 2011, be continued for 30 days to allow the parties to continue their negotiations, and for
5 Mediation to place.

There are no issues that need to be addressed by the parties at the currently

7 scheduled Case Management Conference. In the interest of conserving costs as well as the Court’s
8 time and resources, the parties respectfully request that the Court continue the currently scheduled
9 Case Management Conference.
