On October 28, 2011, the Court granted Defendants’ motion to dismiss but provided
17
Plaintiff an opportunity to file an amended complaint. The Court provided Plaintiff thirty days
18
to file an amended complaint. Plaintiff failed to file an amended complaint within thirty days,
19
but recently filed a letter which the Court construes as seeking more time to file an amended
20
complaint. On January 17, 2011, Plaintiff filed an amended complaint. Therefore, the Court
21
will not dismiss this action for failure to file an amended complaint.
