This is a federal civil rights action filed by a pro se state prisoner pursuant to 42
18
U.S.C. § 1983. By order of the Court, plaintiff was granted 30 days (1) to file a complete
19
application to proceed in forma pauperis (“IFP”), or (2) to pay the filing fee of $350.00, or
20
face dismissal of the action. More than 30 days have passed since the order was filed, and
21
plaintiff has not paid the filing fee, nor filed an IFP application. Accordingly, the action is
22
DISMISSED without prejudice as to plaintiff paying the filing fee, or filing a properly
23
completed IFP application. The Clerk shall enter judgment in favor of defendant, and close
24
the file.
