On June 26, 2012, the government filed a motion for summary judgment, with a noticed

14

hearing date of August 9, 2012. Dkt. No. 17. However, Defendant Thomas Perry failed to file an

15

opposition pursuant to Civil Local Rule 7. Accordingly, the Court hereby VACATES the August 9

16

hearing and ORDERS Thomas Perry to show cause why the government’s motion should not be

17

granted. Defendant shall file a declaration by August 9, 2012. If Defendant files a responsive

18

declaration, the Court shall either issue an order based on the declaration or conduct a hearing on

19

August 23, 2012 at 10:00 a.m. in Courtroom B, 15th Floor, 450 Golden Gate Avenue, San

20

Francisco, California. Defendant is hereby informed that the Court may grant the government’s

21

motion without a hearing if Defendant fails to file a responsive pleading. Thus, it is imperative that

22

Defendant file a written response by the deadline above.
