Plaintiff UNITED STATES EQUAL OPPORTUNITY COMMISSION (hereinafter
22 “Commission” or “EEOC”) and Defendant FREMONT AUTOMOBILE DEALERSHIP, LLC dba
23 FREMONT TOYOTA (hereinafter “FREMONT TOYOTA”) through their counsel have agreed to
24 utilize the Court’s early ADR program and have filed a stipulation/order (and amended
25 stipulations/orders) requesting that the case be referred to mediation. The case has been referred
26 to mediation, mediator Kathryn Dickson, Esq. has been appointed, and pursuant to the Order of
27
November 29, 2011, the mediation is to be completed by February 27, 2012.

The parties request a continuance of pending deadlines for an additional approximate 60
2 days to accommodate the schedules and availability of the selected mediator and individuals
3 necessary to the ADR process, and to allow the parties to attempt to resolve the matter in
4 mediation.

The parties request that the Case Management Conference be continued to April 6, 2012 at
8:30 a.m. in Courtroom 6, 17th Floor, S.F., or on a nearby date acceptable to the Court.

The parties request that the Joint Case Management Statement in compliance with the
