DISPOSITIVE MOTION

Defendant has filed a notice that it cannot file a dispositive motion “at this
16
juncture without further developing the record.” The last day Defendant may file a
17
dispositive motion in this case is June 15, 2012.1 Defendant may not simply file a notice
18
that it is not yet ready to file a dispositive motion by that date because the record has not
19
been sufficiently developed. Discovery has been allowed in this case since November 1,
20
2011, and Defendant shall develop the record to whatever extent it deems necessary for
21
preparing and filing by the deadline.

If Defendant needs additional time to prepare and file a dispositive motion,
23
Defendant shall file a motion for an extension of time no later than five days prior to the
24
deadline sought to be extended. Such a motion must be supported by a showing of good
25

Defendant states that Plaintiff was removed to Nicaragua on November 15, 2011. In
any dispositive motion they file, Defendant shall address what effect that fact has, if any, on
Plaintiff’s claims.

cause for the requested time extension and specify how much additional time is needed.

If Defendant does not file either a dispositive motion or a motion to extend time

by the deadlines set forth above, the case will be set for trial, Defendant will not have a
4
further opportunity to file a dispositive motion, and if necessary counsel will be
5
appointed for Plaintiff.

Plaintiff’s opposition, if any, to the Defendant’s dispositive motion is due within
7
30 days of the date the opposition motion is filed, and Defendant shall file a reply brief
8
within 14 days of the date the opposition is filed. The other provisions of the November
9
1, 2011, Order of Service remain in effect to the extent they are not in conflict with this

order.
