White ____________________________________________________________________________________ STIPULATED BRIEFING SCHEDULE AND [PROPOSED] ORDER 1 CV-11-5108-JSW Case3:11-cv-05108-JSW Document54 Filed04/05/13 Page2 of 4 1 As indicated in the Status Report filed on April 1, 2013, Plaintiff and Federal Defendants have 2 finalized a settlement agreement, and the parties (including Intervenor-Defendant) have negotiated a 3 proposed briefing schedule on a motion to enter the settlement as an order of the Court. See Docket No. 4 52. Accordingly, the parties propose the following and respectfully request that the Court issue an order 5 embodying this schedule: 6  7 8 Joint Motion to Enter Settlement due by April 30, 2013. Plaintiff and Federal Defendants will each file a supporting memorandum with a limit of 10 pages.  9 Defendant-Intervenor’s Opposition due by May 17, 2013 with a limit of 25 pages. If DefendantIntervenor chooses to file a Motion to Dismiss, it will also be filed by May 17, 2013 and the 10 Memorandum in Support of the Motion to Dismiss would be consolidated with their Opposition 11 to the Joint Motion with a total page limit of 25 pages. 12  Reply in Support of the Joint Motion due by June 7, 2013. Plaintiff and Federal Defendants will 13 each file a memorandum with a limit of 25 pages. If Defendant-Intervenor files a Motion to 14 Dismiss, Plaintiff and Federal Defendants will instead each file a combined Reply in Support of 15 the Joint Motion and Opposition to Motion to Dismiss, which would also be due by June 7, 2013 16 with a total page limit of 25 pages. 17  If applicable, Defendant-Intervenor’s Reply in Support of Motion to Dismiss due by June 14, 18 2013 with a total page limit of 15 pages. 19 The specific filing deadlines set forth above shall apply regardless of whether the preceding 20 filing is made on or before of the pertinent deadline.
