TO THE HONORABLE KAMALA HARRIS, Attorney General of the State of

On January 20, 2012, Plaintiffs filed a notice that they were challenging the
14 constitutionality of a California state statute and served the notice by United States mail on
15 the Office of California Attorney General. It does not appear that Plaintiffs completed
16 service in compliance with Federal Rule of Civil Procedure 5.1(a)(2), which requires service
17 “either by certified or registered mail or by sending it to an electronic address designated by
18 the attorney general for this purpose.”

Pursuant to Federal Rule of Civil Procedure 5.1(b) and 28 U.S.C. § 2403(b), the Court
20 certifies that this case draws into question the constitutionality of California Vehicle Code
21 section 14602.6. The Clerk shall serve a copy of this order on the Office of the California
22 Attorney General by certified United States mail. If the State of California chooses to
23 intervene, it must do so no later than March 30, 2012.
