This is a federal civil rights action filed pursuant to 42 U.S.C. § 1983 by a pro se state
19
prisoner. Plaintiff was ordered to file within 30 days a (1) complaint, and (2) a complete
20
application to proceed in forma pauperis (“IFP”), or pay the filing fee of $350.00, or face
21
dismissal of the action. More than 30 days have passed and plaintiff has not filed any of
22
these documents. Accordingly, the action is DISMISSED without prejudice to plaintiff filing
23
a (1) complaint, and (2) a properly completed IFP application. The Clerk shall enter
24
judgment in favor of defendant, and close the file.
