Master File No. 3:07-md-1827 SI, MDL No. 1827 1 2 3 4 5 6 WHEREAS, plaintiff State of Oklahoma (“Oklahoma”) filed an Amended and Restated Complaint (“Amended Complaint”) in the above-captioned on April 12, 2012; WHEREAS, certain Defendants (“Stipulating Defendants”) filed a motion to dismiss the Amended Complaint (“Motion to Dismiss”); WHEREAS, the Court denied in part and granted in part the Motion to Dismiss on September 12, 2012 with leave to amend; 7 WHEREAS, Oklahoma desires to file a Second Amended Complaint; 8 NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED by and 9 10 11 12 13 among the undersigned counsel, on behalf of their respective clients, Oklahoma, on the one hand, and the Stipulating Defendants, on the other hand, as follows: 1. Oklahoma shall file a Second Amended Complaint within thirty (30) days of the filing of this Stipulation; 2. The Stipulating Defendants shall move to dismiss, answer, or otherwise 14 respond to the Second Amended Complaint within forty-five (45) days of the filing of the 15 Second Amended Complaint. 16 17 3.
