(“Plimus”) (collectively, 2 the “Parties”), by and through their undersigned counsel, hereby stipulate and agree pursuant to 3 Federal Rule of Civil Procedure 41(a)(1)(A)(ii) to the dismissal of Yordy’s claims in this action, 4 with prejudice. In support of the instant stipulation, the Parties state as follows: 5 6 7 8 9 10 WHEREAS, pursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii), the Parties may stipulate to the dismissal of this action without a Court order; WHEREAS, the Parties have conferred and agreed to stipulate to the dismissal of Yordy’s individual claims against Plimus in this action with prejudice; and WHEREAS, the Parties have further agreed that they shall each bear their own attorneys’ fees and expenses incurred in any way related to this action. 11 NOW THEREFORE, IT IS HEREBY STIPULATED and AGREED: 12 1) 13 14 15 16 Plaintiff Yordy’s claims against Plimus in this action shall be dismissed with prejudice; and 2) The Parties shall each bear their own attorneys’ fees and expenses incurred in any way related to this action.
