This case is scheduled for a Case Management Conference on June 18, 2012. On April 18,

15

2012, Plaintiff filed a Notice of Motion to Transfer, indicating that it had filed a motion before the

16

United States Judicial Panel on Multidistrict Litigation to transfer this action, along with four other

17

actions, to the Northern District of Illinois for coordinated pretrial proceedings. (See Docket Item

18

No. 145.)

In light of the pending Motion to Transfer, the Court finds that a Case Management

20

Conference would not be fruitful at this time. Accordingly, the Court VACATES the June 18

21

Conference.1 On or before July 9, 2012, the parties shall file a Joint Statement updating the Court

22

on the status of the MDL proceedings.
