(collectively “Plaintiffs”), on the one hand, and Defendants 21 BCMini, LLC, and Miguel Cheng, an individual and d/b/a BC Office Products, BC Office, BC 22 USA and Iwako USA (collectively “Defendants”), on the other hand, and finding good cause 23 therefore, 24 IT IS ORDERED, ADJUDGED AND DECREED THAT: 25 1. Defendants and their agents, servants, employees and attorneys, and all persons in 26 active concert and participation with them, are hereby restrained and enjoined from directly or 27 indirectly infringing Plaintiffs’ Copyrights (depictions of which are attached hereto as Exhibits A 28 and C) and Plaintiffs’ Trademarks (representative lists of which are attached hereto as Exhibits B DC Comics, et al. v. BCMini, et al.: [Proposed] Preliminary Injunction -1 - 1 and D) (collectively “Plaintiffs’ Properties”) in any manner, including generally, but not limited to, 2 the unauthorized manufacture, importation, distribution, advertising, selling and/or offering for sale 3 any wallets, lanyards, key chains, charms, bookmarks, notebooks, bags, personal accessories, and 4 other products bearing depictions of Plaintiffs’ Properties (“Unauthorized Products”), and 5 specifically: 6 a. Importing, manufacturing, distributing, advertising, selling and/or offering for sale 7 the Unauthorized Products or any other unauthorized products which picture, 8 reproduce, copy or use the likenesses of or bear a confusing similarity to any of 9 Plaintiffs’ Properties; 10 c. Importing, manufacturing, distributing, advertising, selling and/or offering for sale 11 in connection thereto any unauthorized promotional materials, labels, packaging or 12 containers which picture, reproduce, copy or use the likenesses of or bear a 13 confusing similarity to Plaintiffs’ Properties; 14 d. Engaging in any conduct that tends falsely to represent that, or is likely to confuse, 15 mislead or deceive purchasers, Defendants’ customers and/or members of the public 16 to believe, the actions of Defendants, the products sold by Defendants, or 17 Defendants themselves are connected with, are sponsored, approved or licensed by 18 Plaintiffs, or are in some way affiliated with Plaintiffs; 19 e. Affixing, applying, annexing or using in connection with the importation, 20 manufacture, distribution, advertising, sale and/or offer for sale or other use of any 21 goods or services, a false description or representation, including words or other 22 symbols, tending to falsely describe or represent such goods as being those of 23 Plaintiffs; 24 f. Destroying or otherwise disposing of: 25 i. Merchandise falsely bearing Plaintiffs’ Properties; ii. Any other products which picture, reproduce, copy or use the likenesses of 26 27 or bear a confusing similarity to any of Plaintiffs’ Properties; 28 DC Comics, et al. v. BCMini, et al.: [Proposed] Preliminary Injunction -2 - 1 iii. Any labels, packages, wrappers, containers or any other unauthorized 2 promotion or advertising material item which reproduces, copies, 3 counterfeits, imitates or bears any of Plaintiffs' Properties; 4 iv. Any molds, screens, patterns, plates, negatives or other elements used for 5 making or manufacturing products bearing Plaintiff’s Properties; 6 v. Any sales and supply of customer journals, ledgers, invoices, purchase 7 orders, inventory control documents, bank records, catalogs and all other 8 business records, believed to concern the manufacture, purchase, advertising, 9 sale or offering for sale of the Unauthorized Products; and 10 2. Defendants will preserve during the pendency of this action: 11 a. All Unauthorized Products bearing Plaintiffs’ Properties, or likenesses 12 thereof; 13 b. Any other unauthorized products which reproduce, copy, counterfeit, imitate 14 or bear any of Plaintiffs’ Properties or which picture, reproduce, copy or use 15 the likeness of or bear a confusing similarity to Plaintiffs’ Properties; 16 c. Any labels, packages, wrappers, containers and any other unauthorized 17 promotional or advertising material which reproduce, copy, counterfeit, 18 imitate or bear any of Plaintiffs’ Properties or which picture, reproduce, 19 copy or use the likeness of or bear a confusing similarity to Plaintiffs’ 20 Properties; 21 d. Any molds, screens, patterns, plates, negatives, machinery, equipment or 22 other elements used for making or manufacturing the Unauthorized Products 23 or unauthorized items which bear Plaintiffs’ Properties or which bear a 24 confusing similarity to any of Plaintiffs’ Properties; and 25 e. Customer journals, ledgers, invoices, purchase orders, inventory control 26 documents, bank records, catalogs, and all other business records reasonably 27 28 DC Comics, et al. v. BCMini, et al.: [Proposed] Preliminary Injunction -3 - 1 believed to reflect or reveal the manufacture, purchase, advertising, sale or 2 offering for sale of the Unauthorized Products. 3 3. Exempted from this Preliminary Injunction is the unauthorized importation of any 4 products bearing Plaintiffs’ Properties if such unauthorized importation is not the result of any 5 selection or intentional decision on the part of Defendants. Should Defendants’ suppliers make a 6 substitution of non-counterfeit goods that would otherwise violate this Preliminary Injunction, 7 without the prior knowledge of Defendants, Defendants shall, within five (5) days of learning of 8 the substitution, (a) send the items back to the source, (b) destroy the items, or (c) contact 9 Plaintiffs’ counsel to arrange for pick up or delivery of the items at Plaintiffs’ own expense, should 10 Plaintiffs so elect. 11 4. This Preliminary Injunction is issued without the posting by Plaintiffs of any 12 additional bond. 13 5. Upon entry hereof, the Temporary Restraining Order herein, dated April 24, 2012, is 14 vacated. 15 6.
