WHEREAS, the Court ordered the parties to complete ADR before the upcoming
Further Case Management Conference on February 7, 2013;

WHEREAS, the parties require conducting some discovery prior to meaningfully
participating in mediation;

WHEREAS, the parties have been in contact with the Court’s ADR-assigned
mediator, David Alexander regarding scheduling the mediation;

WHEREAS, Plaintiff’s deposition is currently set for February 21, 2013;

WHEREAS, the parties do not expect any meaningful ADR can take place prior to

Plaintiff’s deposition being taken;

The parties respectfully request that the Court continue the upcoming Status
Conference by four weeks to March 7, 2013 at 10:30 a.m. to allow the parties to complete ADR by
the time of the Status Conference;

The parties also respectfully request that ADR deadline for completion be extended to
March 6, 2013.
