1 UNITED STATES DISTRICT COURT 2 Northern District of California 3 4 MITCHELL SMITH, 5 No. C 12-2642 MEJ Plaintiff, ORDER RE: STATEMENT OF FACTS v. 6 OVERLAND CONTRACTING, INC., et al., 7 8 Defendants. _____________________________________/ 9 On July 3, 2013, the parties filed a Joint Statement of Facts, which listed five undisputed pages in length, the Court finds that the parties failed to comply with the spirit of the joint statement 12 For the Northern District of California facts. Dkt. No. 38. Given that the facts in Defendant’s Motion for Summary Judgment exceed ten 11 UNITED STATES DISTRICT COURT 10 requirement. Accordingly, the Court ORDERS as follows: 13 (1) Defendant shall file a statement by September 3, 2013, setting forth each material fact on 14 which it relies in support of its Motion. Each material fact in the separate statement must be 15 set forth in a separately numbered paragraph and must refer to a specific admissible portion 16 of the record where the fact finds support (for example, affidavit, deposition, discovery 17 response, etc.). 18 (2) Plaintiff shall file a statement by September 9, 2013, setting forth: (a) for each paragraph of 19 Defendant’s statement of facts, a correspondingly numbered paragraph indicating whether he 20 disputes the statement of fact set forth in that paragraph and a reference to the specific 21 admissible portion of the record supporting his position if the fact is disputed; and (b) any 22 additional facts included in his Opposition, set forth in a separately numbered paragraph and 23 including reference(s) to a specific admissible portion of the record where the fact finds 24 support. 25 IT IS SO ORDERED. 26 27 28 Dated: August 28, 2013 _______________________________ Maria-Elena James United States Magistrate Judge
